Terms of Service

These terms are an agreement between you and Five To Three App LLC, an Illinois limited liability company doing business as Five to Three. By joining the waitlist, becoming a member, creating an account or attending a dinner you agree to them and to our Privacy Policy.

Eligibility

• You must be at least 18 years old, and of legal drinking age if you drink at a dinner.
• You must not be prohibited from using the service by law, and must not have been convicted of a sexual or violent offense.
• You must be single. One account per person, and your profile must be about you and truthful.

Dinners

• Joining the waitlist doesn’t guarantee a seat. We choose who to invite and who sits where.
• Your seat is for you only. Please confirm or decline by the time we ask, so we can offer the seat to someone else.
• You pay for your own food and drinks unless we tell you otherwise before the dinner.
• We may change or cancel a dinner. If we do, we’ll tell you as early as we can.

Membership and payment

• Membership is $5 a month. It gets you invitations to our dinners near you. It does not cover your food or drinks, which you pay the restaurant for.
• Monthly memberships renew automatically each month at the price shown when you joined, charged to the payment method you gave, until you cancel. You can cancel anytime online using the link in your receipt or by emailing us. Cancelling stops future charges, and your membership lasts to the end of the month you’ve paid for.
• If you bought a lifetime membership before we stopped offering it, it lasts as long as we run dinners. It isn’t transferable.
• Refunds: if we can’t seat you at a dinner within a month of joining, email us and we’ll refund your payment in full. Otherwise payments are non-refundable except where the law requires.
• Payments are processed by Stripe. We never see or store your full card number.

Text messages

• If you give us your mobile number and agree to texts, Five to Three will text you about dinner invites, your RSVPs, your membership and replies to messages you send us. Agreeing to texts is never a condition of buying a membership.
• Message frequency varies. Message and data rates may apply.
• Reply STOP at any time to stop texts; we’ll confirm once and send nothing more. Reply HELP for help, or email hello@fivetothreeapp.com.
• Carriers are not liable for delayed or undelivered messages.
• We handle your number as described in our Privacy Policy.

Conduct

At dinners and anywhere you contact someone you met through Five to Three, you agree not to:

• Harass, threaten, pressure or intimidate anyone, or keep contacting someone who hasn’t agreed to it.
• Be disruptive, drink to excess, or be rude to restaurant staff.
• Solicit money, promote businesses, or engage in commercial or sex work.
• Attend under someone else’s name or bring an uninvited guest.

We may remove anyone who breaks these rules from a dinner and from future dinners.

Safety

We don’t conduct criminal background checks and can’t verify every guest’s identity. You are responsible for your own interactions with other guests. Read our safety tips.

Ending your account

You can delete your account at any time. We may suspend or terminate accounts that violate these terms.

Disclaimers

The service is provided “as is”. To the extent permitted by law, we aren’t liable for the conduct of any guest or restaurant, at a dinner or afterwards, or for indirect or consequential damages.
